These Terms of Service ("Terms") govern your purchase and use of Bookzenix, a WordPress appointment booking plugin, together with its updates, documentation, licence service and support (the "Service"), and your use of the website at bookzenix.com.
The Service is provided by Your Legal Business Name, trading as Bookzenix, of Street, City, State/Region, Postcode, Country ("we", "us", "our"). When you buy or use the Service you enter into an agreement with Your Legal Business Name.
1. Accepting these Terms
By purchasing a licence, downloading, installing or continuing to use the Service, you agree to these Terms. If you are using the Service on behalf of a business, you confirm that you are authorised to accept these Terms for that business. If you do not agree, do not use the Service.
2. Orders, payment and our reseller
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, sales tax and VAT, invoices and refunds are governed by the Paddle Buyer Terms, which you accept at checkout. Prices are shown on our Pricing page and may exclude taxes, which are calculated at checkout.
3. Yearly licences and renewals
- Yearly licences renew automatically at the end of each 12-month term at the price shown at the time of renewal, unless you cancel before the renewal date.
- You can cancel renewal at any time from the link in your Paddle receipt or by contacting us. Cancelling stops future charges; your licence remains active until the end of the paid term.
- Lifetime licences are a single payment and do not renew.
- If a renewal payment fails, Paddle may retry it. If it still fails, your licence will stop receiving updates and support.
4. Your licence
When you pay, we grant you a non-exclusive, non-transferable licence to use the Service on the number of websites included in your plan. While your licence is active you receive updates and support. If a yearly licence expires, the plugin continues to function on your sites, but you will not receive updates or support until you renew.
The plugin code is distributed under the GNU General Public License (GPL) version 2 or later where required by WordPress. Your licence key, our update service, support, documentation, brand and website are not covered by the GPL and may not be shared, resold or redistributed.
5. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in breach of any applicable law, including data protection and consumer protection laws;
- use the Service to commit fraud, send spam or unsolicited messages, or mislead your customers;
- infringe the intellectual property or privacy rights of others;
- share, sell or publish licence keys, or try to bypass licence checks;
- interfere with, attack or try to gain unauthorised access to our licence servers, website or other systems.
You are responsible for the content you publish, the bookings you accept and for providing your own customers with any notices and policies required by law.
6. Ownership
Your Legal Business Name owns the Service, the Bookzenix name and logo, the website, documentation and all related intellectual property, subject only to the rights granted to you in these Terms and by the GPL. Feedback you send us may be used to improve the Service without obligation to you.
7. Availability and warranty
We work hard to keep the Service reliable and compatible with current versions of WordPress and PHP, but we do not guarantee that it will be uninterrupted, error-free or compatible with every theme, plugin or hosting environment. The Service is provided "as is" and "as available". Third-party services you connect, such as payment gateways, calendars, SMS or video providers, are governed by their own terms. Nothing in these Terms limits any rights you have as a consumer that cannot be excluded by law.
8. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for loss of profits, revenue, data or bookings. Our total liability arising from the Service is limited to the amount you paid for it in the 12 months before the claim. Keep regular backups of your website and database.
9. Refunds
You may request a full refund within 30 days of purchase. Full details are in our Refund Policy.
10. Suspension and termination
We may suspend or terminate your licence, updates and support if you materially breach these Terms, fail to pay, share or resell licence keys, create a security or fraud risk, or repeatedly violate these Terms after notice. You may stop using the Service at any time. Sections 4 (GPL rights), 6, 7, 8 and 12 survive termination.
11. Changes to these Terms
We may update these Terms from time to time. The date at the top shows the latest version. If a change materially affects you, we will tell you by email or on this website before it takes effect. Continued use after the change means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of India. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.
